LIMITATIONS OF ASSOCIATION LIABILITY

Members of the Association, their guests and visitors, may use the facilities of the Association and attend rallies entirely at their own risk and impliedly accept that:—

1 The Association will not accept any liability for any damage to or loss of property belonging to members, their guests or visitors to the Association.

2 The Association will not accept any liability for personal injury arising out of participation in any rally or event organised by the Association, whether sustained by members, their guests or visitors, or caused by the said members, guests or visitors, whether or not such damage or injury could have been attributed to and was occasioned by the neglect, default or negligence of any of the officers, committee or servants of the Association.

3 Rally organisers shall not be liable for any loss, damage, death or personal injury howsoever caused to the owner, skipper or crew, as a result of their taking part in a rally. Moreover, every owner warrants the suitability of his boat for the rally.

4 ‘Responsibility of a Yacht or Dinghy’ provides that ‘it shall be the sole responsibility of each Yacht or Dinghy to decide whether or not to start or continue with a rally.’
